Parish Council meeting to be held in the village hall on FRIDAY 30th January at 6p.m.

Residents welcome, though on this occasion there will be no Open Meeting to leave time for the Councillors to consider the only item on the Agenda.

MINUTES

3. EVENLODE GROUNDS & CDC DECISION RE: CHANGE OF USE:

Evenlode Parish Council unanimously resolves to contribute £1000 towards the cost of Planning Counsel’s fee in drafting and issuing a pre-action protocol letter in relation to planning applications 25/03407/OPANOT and 25/03404/AGRPAN on the grounds that the decision relating to both appears to have been taken in error of law; that it materially affects the parish, and that the expenditure is in the public interest and proportionate.”

REASONS:

The PC relies upon Counsel’s Opinion – Andrew Trollope KC of Adlestrop instructed Counsel and has shared his opinion with Evenlode PC;

The issue is in the public interest – 3 villages (Adlestrop, Evenlode & Broadwell) are affected; the issue concerns public highway safety, and the sustainability of the local network of little lanes;

There are sufficient funds in the Evenlode PC account to fund the payment of £1000 – the balance at the bank as at 29/01/2026 was £7…. (and there are no anticipated payments due to be taken out of the account up to the end of financial year), and it is a one third share of the total of Counsel’s fee;

The sum of £1000 is payable by virtue of s. 137 of the Local Government Act 1972. The sum per resident is in 2025-2026 is £11.10. There are 127 residents on the Evenlode Register of Electors. The action of serving a Pre-Action Protocol Letter benefits the area and the action is reasonable with a reasonable chance of success & is a cost effective way of addressing the issue.

The resolution was proposed by JL and seconded by CJ at a public PC meeting held on 30/01/2026 in the VH at 6 p.m..

There being no other business, the meeting closed at 7p.m.
